By accessing or using the ZESTAY platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

ZESTAY is a cloud-based hotel property management system (PMS) offered as Software-as-a-Service (SaaS). The Service allows hotel owners and managers to manage bookings, rooms, housekeeping, billing, staff, and guest records through a web-based dashboard.

3. Account Responsibilities

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years old to create an account.

4. Subscriptions & Payments

ZESTAY offers both free and paid subscription plans. Paid subscriptions are billed as specified in your chosen plan. Payments are processed securely through Razorpay.

  • Subscription fees are non-refundable except where required by law.
  • We reserve the right to change pricing with 30 days' advance notice.
  • Failure to pay may result in suspension or termination of your account.
  • Free plans may have feature or usage limitations as described on our pricing page.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code, viruses, or harmful content
  • Resell, sublicense, or redistribute access to the Service without permission
  • Use the Service to store or transmit content that violates any third-party rights

6. Your Data

You retain ownership of all data you enter into the Service (hotel information, bookings, guest records, etc.). We do not claim any ownership rights over your content. Please refer to our Privacy Policy for details on how we handle your data.

7. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. We may perform scheduled maintenance, and the Service may experience occasional downtime. We will make reasonable efforts to notify you in advance of planned outages.

8. Intellectual Property

The ZESTAY platform, including its design, code, logos, and documentation, is the intellectual property of ZESTAY and is protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period.

9. Limitation of Liability

To the maximum extent permitted by law, ZESTAY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
